Ferkesh LLC (“Ferkesh,” “we,” “us,” or “our”) operates Premium Dispatcher, a brand of Ferkesh LLC. These Terms of Service (“Terms”) govern access to and use of the Premium Dispatcher website and application services (together, the “Services”).

Access and organizational authority

You may use the Services only if you can form a binding agreement and are authorized to act for yourself or the organization whose account you use. Access may require owner approval, an invitation, an enabled membership, and applicable entitlements. A public request for access does not create an account, begin an automatic trial, or establish a paid subscription.

Accounts and security

You are responsible for safeguarding account credentials, using the Services only through your own authorized access, and promptly reporting suspected unauthorized access. You may not share passwords, bypass security or company boundaries, or use another person’s or organization’s account without permission.

Acceptable use

• Do not use the Services unlawfully, fraudulently, or to violate another person’s rights.
• Do not interfere with, probe, overload, reverse engineer, or circumvent the security or operation of the Services except where applicable law expressly permits it.
• Do not upload malicious code, attempt unauthorized access, or misuse personal, operational, or confidential information.
• Use transportation, dispatch, driver, customer, and operational information only when you have the authority and lawful basis to do so.

Customer content and responsibilities

You and your organization remain responsible for information submitted to the Services, the accuracy of operational decisions, required notices and permissions, and compliance with laws and obligations that apply to your activities. You grant Ferkesh the limited rights needed to host, process, transmit, back up, and otherwise handle that information to provide and secure the Services.

Service availability and changes

Features and availability depend on the approved account configuration, roles, entitlements, and implementation scope. Ferkesh may maintain, improve, limit, suspend, or discontinue portions of the Services when reasonably necessary for security, reliability, legal compliance, or product operation. No website statement guarantees uninterrupted or error-free operation.

Third-party services

Some capabilities may depend on separately configured third-party services. A capability described as ready or supported is not a representation that a provider is currently enabled. Third-party terms may apply when a provider is later configured and authorized.

Billing, cancellation, and refunds

Premium Dispatcher does not currently process paid subscriptions through this website. Billing, cancellation, and refund terms will be published before paid services and payment processing are made available.

Ownership

The Services, software, site design, documentation, trademarks, and other Ferkesh materials are owned by Ferkesh or its licensors and are protected by applicable law. These Terms do not transfer ownership of those materials or of customer content.

Suspension and termination

Access may be suspended or terminated when authorization ends, an account or membership is disabled, these Terms are materially violated, or action is reasonably necessary to protect the Services, users, or others. Obligations that by their nature should continue after termination remain in effect.

Governing law

These Terms and any dispute arising out of or relating to these Terms or the Services are governed by the laws of the State of West Virginia, United States, without regard to conflict-of-law principles, except to the extent that mandatory laws in a customer’s jurisdiction apply.

These Terms do not impose mandatory arbitration, an exclusive venue, a jury-trial waiver, or a class-action waiver.

Changes and contact
